These Terms & Conditions (the “Terms”) govern your access to and use of SunCoastElements.com and any related webpages, features, content, communications, and services (collectively, the “Site”), as well as your purchase and use of products sold through the Site.

SunCoast Elements is a consumer brand owned and operated by Black Rabbit Brands. Throughout these Terms, “SunCoast Elements,” “we,” “us,” and “our” refer to the operator of the Site and the seller of products offered through it. Black Rabbit Brands processes orders and administers customer service, shipping, returns, and refunds for SunCoast Elements.

Please read these Terms carefully. By accessing the Site, creating an account, submitting an order, or otherwise using the Site, you agree to be bound by these Terms and our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree, do not use the Site or purchase our products.

1. Age and Eligibility

The Site and all hemp-derived cannabinoid products sold through it are intended only for adults who are 21 years of age or older. By accessing the Site or placing an order, you represent and warrant that:

  • You are at least 21 years old;

  • You have the legal capacity to enter into these Terms;

  • You are purchasing only for yourself or another legally eligible adult, and not for resale unless we have authorized you in writing; and

  • Your access, purchase, possession, and use of the products are lawful in your jurisdiction.

We may use age-verification measures and may request additional identification. We may refuse or cancel an order if age or identity cannot be verified. Products may not be delivered to or accepted by a minor.

2. Product and Health Disclosures

SunCoast Elements offers hemp-derived cannabinoid products, which may include products containing THC, CBD, THCV, or other cannabinoids. Product ingredients, cannabinoid content, serving information, warnings, and instructions appear on the applicable product page, packaging, or certificate of analysis.

Unless expressly stated otherwise, our products have not been evaluated or approved by the U.S. Food and Drug Administration to diagnose, treat, cure, or prevent any disease. Information on the Site is provided for general educational purposes only and is not medical advice or a substitute for advice from a qualified healthcare professional.

Before using a product, consult a healthcare professional, particularly if you are taking medication, have a medical condition, are sensitive to cannabinoids, or have concerns about potential interactions. Do not use cannabinoid products if you are pregnant, nursing, or trying to become pregnant without first consulting a qualified healthcare professional.

Products containing THC may cause impairment, drowsiness, or intoxication. Do not drive, operate machinery, or engage in hazardous activities after use. Use may result in a positive drug test. Effects vary by person and may be delayed. Do not exceed the labeled serving. Keep all products securely stored and out of reach of children and pets.

If you experience a serious or unexpected reaction, stop use and seek appropriate medical attention. Call 911 in an emergency.

3. Legal Compliance and Geographic Restrictions

Cannabinoid laws and regulations vary by jurisdiction and may change without notice. A product’s appearance on the Site does not mean that it may legally be purchased, possessed, shipped, or used in every location.

We reserve the right to restrict sales, refuse service, cancel orders, require additional verification, or stop shipping any product to any state, territory, municipality, or address when we believe the transaction may be prohibited or create legal, regulatory, safety, fraud, or operational risk.

You agree not to purchase, transport, export, resell, or use any product in violation of applicable law. Our right to refuse or cancel an order does not transfer our legal compliance obligations to you.

4. Accounts and Account Security

You may be required to create an account to use certain Site features. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify us promptly at Hello@SunCoastElements.com if you suspect unauthorized use of your account. We may suspend or terminate accounts that contain inaccurate information, appear compromised, or are used in violation of these Terms.

5. Product Information and Availability

We try to describe and display products accurately, but colors, appearance, packaging, and other details may differ slightly from what appears on your device. Product formulations, packaging, availability, and specifications may change as permitted by law.

We do not guarantee that every description, price, image, laboratory result, or other item of Site content is error-free or complete. We may correct errors, update information, limit quantities, or discontinue products at any time. If a material error affects an order you have already placed, we may contact you, offer an appropriate correction, or cancel and refund the affected portion of the order.

6. Orders and Acceptance

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not constitute acceptance. We accept an order when it is processed for fulfillment or shipped, subject to applicable law.

We may reject, limit, or cancel an order for reasons including product availability, suspected fraud, pricing or description errors, failed age verification, payment issues, shipping restrictions, suspected resale, or legal and regulatory concerns. If we cancel after payment is captured, we will refund the amount charged for the canceled item or order to the original payment method.

7. Prices, Taxes, and Payment

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Taxes, shipping charges, and other applicable fees will be disclosed before you complete your purchase.

You represent that you are authorized to use the payment method submitted. You authorize us and our payment providers to charge the total amount shown at checkout. Payment services may be governed by additional third-party terms.

8. Promotions and Discount Codes

Promotions, discounts, gifts, and loyalty offers are subject to the terms presented with the offer. Unless otherwise stated, offers cannot be combined, have no cash value, may be limited by customer or household, and may be changed or ended as permitted by law. We may cancel orders involving misuse, manipulation, or unauthorized distribution of a promotion.

9. Shipping, Delivery, and Risk of Loss

Shipping options, estimated delivery times, charges, and restrictions are described at checkout or in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Delays may occur because of carriers, weather, regulatory review, address issues, age verification, or events outside our reasonable control.

You are responsible for providing a complete and accurate deliverable address. We do not ship to locations where a product is prohibited or where our carriers or compliance standards do not permit delivery.

Title and risk of loss pass as provided by applicable law and the terms of the carrier. If a shipment is lost, damaged, refused, or marked delivered but not received, contact us at Hello@SunCoastElements.com so we can review the issue under our Shipping Policy.

10. Returns, Refunds, and Replacements

Returns, refunds, damaged-product claims, and replacements are governed by our Return & Refund Policy in effect at the time of purchase. Because cannabinoid products are ingestible, opened or used products generally cannot be returned unless required by law or accepted by us because of damage, defect, or fulfillment error.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer-protection law.

11. Subscriptions and Automatic Renewal

If we offer a subscription or automatic-renewal program, its material terms—including the products included, price, billing frequency, renewal timing, cancellation method, and any trial or promotional period—will be disclosed before enrollment.

By affirmatively enrolling, you authorize recurring charges to your selected payment method until you cancel. You may cancel using the method disclosed at enrollment or by contacting Hello@SunCoastElements.com. Cancellation applies to future renewals and does not retroactively refund an order already processed, except as required by law or stated in the applicable offer.

If there is a conflict between this section and the subscription terms displayed at enrollment, the terms displayed at enrollment control to the extent permitted by law.

12. Intellectual Property

The Site and its content—including the SunCoast Elements name, logos, designs, graphics, photographs, videos, text, product names, packaging, software, and overall look and feel—are owned by or licensed to SunCoast Elements and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, lawful, noncommercial use. You may not copy, reproduce, modify, distribute, sell, scrape, frame, publish, create derivative works from, or commercially exploit Site content without our prior written permission.

13. Reviews and User Content

If you submit a review, photograph, comment, testimonial, suggestion, or other content (“User Content”), you represent that you own or have permission to submit it; that it is truthful and based on your genuine experience; and that it does not violate any law or another person’s rights.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, adapt, publish, display, distribute, and create derivative works from your User Content for operating, improving, and promoting SunCoast Elements, subject to applicable law and our Privacy Policy.

Do not submit medical or disease-treatment claims, unlawful content, confidential information, or content that is false, misleading, defamatory, infringing, or harmful. We may moderate or remove User Content, but we are not required to do so.

14. Prohibited Conduct

You may not:

  • Use the Site or products for an unlawful, fraudulent, or abusive purpose;

  • Purchase products for or provide products to anyone under 21;

  • Attempt to bypass age, identity, payment, purchase-limit, or shipping controls;

  • Interfere with the Site’s security, operation, or networks;

  • Introduce malware or harmful code;

  • Use bots, scraping tools, or automated systems without our written permission;

  • Impersonate another person or provide false information;

  • Infringe intellectual-property, privacy, publicity, or other rights; or

  • Resell products without our written authorization.

We may suspend access, cancel orders, or take other appropriate action if we reasonably believe this section has been violated.

15. Third-Party Services and Links

The Site may contain links to or rely on services operated by third parties, including payment processors, shipping carriers, age-verification providers, social platforms, and other websites. We do not control and are not responsible for third-party services, content, security, availability, or privacy practices. Your use of those services may be governed by separate terms.

16. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy. By using the Site, you consent to receive transactional communications electronically, including order confirmations, account notices, policy updates, and customer-service messages.

Marketing emails and text messages are subject to the consent terms presented when you subscribe. Consent to marketing is not a condition of purchase. You may opt out of marketing emails through the unsubscribe link and of text messages by replying STOP, subject to any instructions disclosed at enrollment.

17. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT, AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SUNCOAST ELEMENTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT A PRODUCT WILL PRODUCE A PARTICULAR EXPERIENCE OR RESULT. NATURAL VARIATION, INDIVIDUAL RESPONSE, STORAGE, AND USE MAY AFFECT PRODUCT EXPERIENCE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SUNCOAST ELEMENTS AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR A CLAIM ARISING FROM OR RELATED TO THE SITE, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM OR (B) $100.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SunCoast Elements and its owners, affiliates, officers, directors, employees, agents, licensors, service providers, and suppliers from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site or products, your material violation of these Terms, or your infringement of another person’s rights.

20. Dispute Resolution, Arbitration, and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

Before filing a formal claim, you and SunCoast Elements agree to try to resolve the dispute informally. You must send a written notice describing the dispute and requested relief to Hello@SunCoastElements.com and PO Box 222, Oakdale, NY 11769. We will send notices to the contact information associated with your account or order. The parties will have 30 days after receipt of notice to attempt an informal resolution.

Except for an eligible small-claims matter or a request for temporary or preliminary injunctive relief involving intellectual-property misuse, any dispute arising from or relating to these Terms, the Site, or a product will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration provision.

The arbitration may be conducted by telephone, video conference, written submissions, or in person in the county where you live, unless the parties agree otherwise. The arbitrator may award the same individual remedies a court could award. Arbitration will occur only on an individual basis. Neither party may bring or participate in a class, collective, consolidated, mass, or representative action or arbitration.

You may opt out of this arbitration provision by sending written notice to Hello@SunCoastElements.com within 30 days after you first accept these Terms. Your notice must include your full name, mailing address, the email address used for your account or order, and a clear statement that you are opting out of arbitration. Opting out will not affect the remaining Terms.

If any part of the class-action waiver is found unenforceable for a particular claim, that claim must proceed in court and not in class arbitration. If the arbitration provision is found entirely unenforceable or you timely opt out, Section 21 governs the forum for disputes.

21. Governing Law and Court Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where federal law applies or applicable consumer law requires otherwise.

Any court proceeding permitted under these Terms must be brought in the state or federal courts located in Suffolk County, New York, and each party consents to their personal jurisdiction, unless applicable law gives you the right to bring a claim in another forum.

22. Changes to the Site and These Terms

We may update the Site, products, policies, or these Terms from time to time. The updated Terms will be posted with a revised “Last updated” date. Changes apply prospectively unless otherwise stated or required by law. If a change is material, we will provide any additional notice required by law.

Your continued use of the Site after updated Terms take effect constitutes acceptance of the updated Terms. Changes to the arbitration provision will not apply to a dispute of which we had actual notice before the change became effective.

23. Termination

You may stop using the Site at any time. We may suspend or terminate access, cancel an account, or refuse service if we reasonably believe you violated these Terms, created risk or potential legal exposure, or engaged in fraudulent or abusive conduct.

Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limitations, indemnification, dispute resolution, and governing law—will survive.

24. General Terms

These Terms and the policies incorporated by reference constitute the entire agreement between you and SunCoast Elements concerning the Site and purchases made through it. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. We are not responsible for delay or failure caused by events beyond our reasonable control.
