These Terms and Conditions (the “Terms”) apply to purchases of SunCoast Elements clothing, headwear, accessories, and other non-ingestible merchandise through SunCoastElements.com (the “Site”), and to your use of the Site in connection with those purchases.

SunCoast Elements is owned and operated by Black Rabbit Brands. In these Terms, “SunCoast Elements,” “we,” “us,” and “our” refer to Black Rabbit Brands, the operator of the Site and seller of SunCoast Elements merchandise. Black Rabbit Brands administers orders, payments, customer service, shipping, returns, and refunds.

These Terms cover clothing and merchandise only. They do not govern the purchase or use of hemp-derived cannabinoid products. Any separately stated restrictions on access to the Site remain applicable.

By placing an order and accepting these Terms at checkout, you agree to these Terms and the Shipping Policy and Return & Refund Policy made available before purchase. Our Privacy Policy explains how we handle personal information.

1. Eligibility and Accounts

You must have reached the age of legal majority in your jurisdiction and have the legal capacity to enter into a binding agreement to place an order. You must provide accurate billing, shipping, contact, and payment information and be authorized to use the payment method submitted.

If you create an account, keep your login credentials secure and notify us promptly of suspected unauthorized access. We may restrict accounts used for fraud, unlawful activity, or material violations of these Terms.

2. Product Descriptions, Sizing, and Appearance

Please review each product’s description, materials, fit notes, size chart, and care instructions before ordering. Sizing and fit may differ between styles. Measurements are approximate and may be subject to reasonable manufacturing tolerances described on the product page.

We make reasonable efforts to display products accurately. Screen settings and photography may cause minor differences in displayed color. Garment-dyed, mineral-washed, distressed, embroidered, or individually finished pieces may have variations in shade, texture, finish, or graphic placement consistent with the product description.

These variations do not excuse material differences from the advertised product or manufacturing defects. Product changes apply to future listings and orders; we will not substitute a materially different item without your agreement.

3. Garment Care

Follow the care label and any product-specific instructions. Improper washing, drying, bleaching, ironing, storage, or alteration can damage fabric, prints, embroidery, and finishes. Normal wear and damage caused by improper care are not manufacturing defects. This provision does not limit rights relating to defective products, inaccurate care instructions, or other rights protected by law.

4. Orders and Availability

An order confirmation acknowledges receipt of your order. We accept your order when we send a shipment confirmation, unless we expressly accept it earlier. This acceptance process does not postpone our legal shipping or refund obligations.

We may limit quantities or reject or cancel orders because of unavailable inventory, suspected fraud, payment failure, material listing errors, or legal restrictions. If an error affects your order, we will contact you to obtain agreement to a correction or cancel the affected items and issue an appropriate refund. We will not increase the price of a submitted order without your consent.

If we cancel an order after collecting payment, we will promptly refund the canceled portion, including applicable taxes and shipping charges, to the original payment method as required by law.

5. Pricing and Payment

Prices are in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, and other fees will be disclosed before you complete checkout. Price changes do not alter an already accepted order.

By submitting payment, you authorize the charge displayed at checkout. Payments may be processed by third-party providers under their applicable terms. Where international shipping is offered, any customer responsibility for import duties or local taxes will be disclosed before purchase.

6. Promotions and Limited Releases

Discount codes, sales, free-shipping offers, promotional gifts, and limited releases are subject to the conditions disclosed with each offer, including eligibility, dates, minimum purchase amounts, exclusions, and availability. Offers may not be combined unless expressly permitted.

We may end or change an offer prospectively, but will honor valid offers applied to accepted orders. Any effect a return has on a promotional gift or qualifying discount will be disclosed in the offer terms or Return & Refund Policy before purchase. We may reject transactions involving fraudulent use of an offer.

7. Preorders, Made-to-Order, and Personalized Items

Where offered, preorder, made-to-order, or personalized status will be identified on the product page, together with the applicable production or shipment timeframe and any special cancellation or return conditions.

Made-to-order status alone does not make an item final sale. Any restriction must be clearly disclosed before purchase and remains subject to applicable law. Personalized or final-sale items retain any legally required remedies for defects, incorrect fulfillment, or non-delivery.

8. Shipping and Delivery

Available destinations, processing times, shipping charges, and delivery estimates appear in our Shipping Policy, on product pages, or at checkout. Carrier delivery estimates are not guarantees unless expressly stated otherwise.

We will ship within the timeframe represented at purchase or, if none is stated, within the period required by applicable law. If we cannot ship on time, we will provide the required delay notice and cancellation or refund options, obtain any required consent, and cancel and refund where required.

Please provide a complete, accurate shipping address. Contact us promptly to request corrections; changes may not be possible after fulfillment begins. Any additional charge for customer-requested reshipment will be disclosed for approval before charging.

For lost, damaged, or missing deliveries, contact Hello@SunCoastElements.com with your order number. We will investigate and provide the resolution required by our policies and applicable law. Carrier tracking alone does not eliminate your legal rights, and these Terms do not automatically transfer all shipping risk to you when a parcel is handed to a carrier.

9. Cancellations, Returns, Exchanges, and Refunds

Our Return & Refund Policy in effect at purchase governs voluntary returns and exchanges, including the request window, item condition, proof of purchase, return authorization, shipping costs, exclusions, and refund timing. That policy must be available before checkout. The Shipping Policy governs shipping-specific procedures.

Contact us promptly to request an order change or cancellation. Once production or fulfillment begins, we may be unable to accommodate a voluntary change; this does not affect cancellation or refund rights provided by law.

If an item arrives damaged, defective, or incorrect, contact Hello@SunCoastElements.com with your order number and a description of the problem. Photographs can help us review the issue. We will arrange an appropriate remedy and cover required return or replacement shipping where the issue results from our error or a product defect.

Any final-sale designation must be disclosed before purchase. It does not remove non-waivable consumer rights. A change to our policies after purchase will not retroactively reduce your rights for that order.

10. Intellectual Property

Our names, logos, artwork, designs, photographs, text, videos, and other Site content are owned by us or used with permission. Purchasing merchandise does not transfer intellectual-property rights or authorize commercial reproduction of our designs.

You may use the Site for lawful personal shopping. You may not reproduce or commercially exploit protected Site content without permission, except as permitted by law. Third-party trademarks remain the property of their respective owners.

11. Reviews and Submitted Content

Reviews must reflect genuine experiences. You retain ownership of content you submit. By submitting a review or photograph through our review tools, you grant us a non-exclusive, royalty-free license to host, display, and format it for presentation with our products and reviews, subject to applicable law and our Privacy Policy.

We will seek separate permission before using your photograph or likeness in advertising beyond that context. You must have the necessary rights to submit content. We may remove spam, unlawful content, personal information, or content unrelated to the product, but will not prohibit or penalize honest negative reviews.

12. Acceptable Use and Third-Party Services

You may not use the Site for fraud, impersonation, infringement, harassment, malicious code, unauthorized access, or interference with its operation. We may restrict access where reasonably necessary to address such conduct, while honoring existing lawful order and refund obligations.

Third-party websites and services may have separate terms and privacy practices. Their availability is outside our control. Use of a payment processor, fulfillment partner, or carrier does not remove our obligations to you as the seller.

13. Privacy and Communications

Our Privacy Policy describes our handling of personal information. We may send transactional communications relating to orders, delivery, account security, and customer service.

Marketing emails and texts are governed by the consent terms presented at signup. Marketing consent is not a condition of purchase. You may unsubscribe from marketing emails through the provided link or follow the opt-out instructions for text messages, including replying STOP where applicable.

14. Warranties and Liability

We do not guarantee uninterrupted or error-free Site access. To the extent permitted by law, the Site itself is provided “as available.” Nothing in these Terms disclaims an express product promise or excludes a warranty or remedy that cannot legally be excluded.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Site or merchandise. This limitation does not apply to fraud, willful misconduct, gross negligence, personal injury caused by our acts or omissions, or any liability that cannot legally be excluded or limited. It does not restrict legally required refunds, replacements, or other consumer remedies.

15. Governing Law and Disputes

These Terms are governed by New York law, subject to applicable federal law and any mandatory consumer protections of your jurisdiction.

If a problem arises, please contact Hello@SunCoastElements.com so we can try to resolve it. Contacting us is encouraged but is not a prerequisite to exercising legal rights and does not shorten applicable filing deadlines.

Subject to your right to use another forum where required by law, disputes may be brought in courts with jurisdiction in Suffolk County, New York. These Terms do not impose mandatory arbitration or waive the right to bring an eligible small-claims case.

16. Changes and General Provisions

We may revise these Terms prospectively by publishing an updated version and providing any notice or obtaining any consent required by law. The Terms accepted for an order govern that order. Later changes do not retroactively alter an existing purchase or dispute.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision is not a waiver. Events outside our reasonable control may affect performance, but do not excuse legally required notices, cancellations, or refunds.

For apparel purchases, these Terms and the purchase-specific policies disclosed before checkout govern. If the Site also sells other product categories, their additional terms apply only as expressly stated and do not reduce mandatory rights associated with merchandise purchases.
